Property and Evidence Release

If you wish to pick up your property it is mandatory that you call and make an appointment to pick up your property between 8:00 AM - Noon & 1:00 PM - 4:30 PM, Monday through Friday excluding holidays.

Evidence

Please wait 60 days after the adjudication of your case before contacting the Property Evidence Unit.  You must call the Evidence Unit to set up an appointment and you must provide your adjudication paperwork stating specifically what items are to be returned to you.

Property Held for Observation

Property will be held for 72 working hours pending issuance of a complaint.  After 72 working hours the property may be returned upon proof of ownership and IF NO CHARGES HAVE BEEN FILED.

Property Held due to Mental Illness / Psychiatric Commitment

Weapons that have been seized on an police officer hold or voluntary psychiatric commitment will be held for a period of no less than 30 days.  To have your weapon returned you must file a written request within 30 days of seizure.  Once a letter is received, an appointment can be made once the 30 day hold period has expired.  If you do not file a written request, the weapon(s) will be destroyed without further notice.​
 

Found Property

ORS 98.005 explains the rights and duties of the finder of money and/or goods.  Finder must submit written notice to the Sheriff's Office within 10 days of finding that the finder claims the property if an owner is not located.  ORS 98.025 explains the rights of the owner. ​
 

Stolen or Embezzled Property

You have 15 days from the date of seizure to assert any rights you may have in the property taken from you.  Upon the filing of a declaration of ownership, and after you have been given an opportunity to be heard on the matter, the property may be returned to you once all criminal investigation is completed.  If criminal charges are filed, refer to the section regarding Evidence.
 

Safekeeping

Items held for safekeeping will be held for 90 days, if you do not make an appointment within 90 days of seizure, items will be disposed of.
 

Weapons

Prior to any weapon being released a background check will be performed to ascertain your legal eligibility to receive the weapon. Ammunition WILL NOT be released on the same day as the weapon.  You must make a separate appointment to pick up ammunition.​
